1. Agreement to Terms
By accessing or using SitRep Reporting ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.
These terms constitute a legally binding agreement between you (the "Organisation") and SitRep Reporting ("we", "us", "our").
2. Description of Service
SitRep Reporting is a cloud-based incident reporting platform designed for Australian security companies. The Service allows organisations to:
- Create custom incident report forms
- Distribute forms to field officers via unique URLs or QR codes
- Receive and manage submitted reports through a secure dashboard
- Export reports as PDF documents
- Receive email notifications of new submissions
3. Organisation Responsibilities
As an Organisation using the Service, you are responsible for:
- Ensuring that all officers submitting reports through your forms are authorised to do so
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Complying with all applicable laws and regulations in your use of the Service
- The accuracy and legality of all data submitted through your forms
- Obtaining necessary consents from officers for the collection and processing of their personal information
- Properly securing and managing access to your organisation's public form URLs
4. Acceptable Use Policy
You agree not to use the Service to:
- Upload, transmit, or distribute any unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable content
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Attempt to gain unauthorised access to other organisations' data
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Use the Service to spam, harass, or send unsolicited communications
- Reverse engineer, decompile, or attempt to extract source code from the Service
We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy.
5. Data Ownership and Privacy
You retain all ownership rights to the data you submit through the Service. We do not claim any ownership over your incident reports, photos, or other content.
Our collection, use, and storage of personal information is governed by our Privacy Policy, which forms part of these Terms of Service.
6. Service Availability
While we strive to provide reliable service, we do not guarantee that the Service will be available at all times or that it will be error-free. We may suspend or restrict access to the Service for maintenance, updates, or other operational reasons.
We are not responsible for any loss or damage resulting from service interruptions, including but not limited to lost data or missed incident reports.
7. Limitation of Liability
Important Notice
To the maximum extent permitted by law, SitRep Reporting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
Our total liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless SitRep Reporting and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Any content submitted through your organisation's forms
9. Termination
You may terminate your account at any time by contacting us. Upon termination, you will lose access to the Service and your data may be deleted in accordance with our data retention policies.
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activity.
10. Changes to Terms
We may modify these Terms from time to time. We will notify organisations of material changes via email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Queensland, Australia, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
12. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SitRep Reporting regarding the Service and supersede any prior agreements.
